This Privacy Policy explains what personal information we collect, how we use it, who we share it with, and what choices you have. It applies to:
our online ordering website at order.masdonuts.com,
the Ma's Donuts mobile app for iPhone and iPad, and
our rewards program and the accounts you create to use either one.
By creating an account, placing an order, or joining our rewards program, you agree to this Policy.
1. Information we collect
Information you give us
Account information. When you create an account we collect your first name, your email address, and a password. A last name and a mobile phone number are optional, though a phone number is how we text you when your order is ready. If you sign in with Apple, Apple sends us your name and either your email address or the private relay address Apple generates for you. We never see your Apple ID password.
Order information. The items you order, any options or modifiers you choose, the pickup time you select, any note you add for the kitchen, and the order's total and status. We keep a history of your past orders so you can view and reorder them.
Payment information. Card payments are handled by Square, our payment processor. When you pay by card, your card details go directly to Square, which returns a one-time payment token to us. We do not receive or store your full card number, expiration date, or security code. If you pay with Apple Pay, Apple and Square handle the card details in the same way. We store only what Square gives back to us, such as the card brand, the last four digits, and a payment record for your receipt. If you choose to save a card for faster checkout, we keep only that token, the card brand, and the last four digits so you can reuse it on future orders. We never store your full card number, and you can remove a saved card at any time in the app. Gift card balances and gift card numbers are likewise held by Square.
Rewards program information. Your member number and member code, your points balance, your status points and reward tier, the offers and coupons you have claimed or redeemed, and purchases made in our shops when you present your member code at the counter.
Communications with us. If you contact us for support through the app or by email, we keep your message and our replies so we can help you and follow up.
Saved preferences. Items you mark as favorites, and any items you save for later.
Information we collect automatically
Device and app information. Your device type and operating system version, the app version you are running, general diagnostic and crash information, and a request identifier we attach to each request so our support team can trace a specific problem you report.
App usage. We collect first-party information about how you use the app — for example which screens you view — so we can understand what is useful and improve it. This is our own analytics: it is linked to your account, used only by us, never used to track you across other companies' apps or websites, and never sold or shared with advertising networks.
Website information. Your IP address, browser type, pages viewed, and similar activity on our ordering website. Our website uses cookies and similar technologies for essential functions such as keeping you signed in and keeping your cart intact, and to understand how the site is used so we can improve it.
Push notification tokens. If you turn on push notifications, your device gives us a notification token so we can send you order updates and offers. You can turn notifications off at any time in your device settings.
Information we do not collect
We do not collect your precise or approximate location. The app does not request location access.
We do not access your camera, photos, microphone, contacts, health data, or files.
We do not track you across other companies' apps and websites, and we do not allow third-party advertising networks to do so through our app or website.
We do not knowingly collect information from children under 13. See section 8.
2. How we use your information
We use your information to:
take, prepare, and complete your orders, and to hold your cart between visits;
process payments, issue receipts, and handle refunds and gift cards;
run our rewards program, including awarding points, calculating your tier, and issuing and redeeming coupons and offers;
text or notify you when your order is accepted, being made, and ready;
send you one-time security codes when you reset your password or verify your account;
answer your questions and provide customer support;
keep our accounts, our app, and our customers secure, including detecting and preventing fraud and abuse;
meet our legal, tax, and accounting obligations;
send you marketing about our products, services, and special offers, where you have agreed to receive it; and
understand how our app and website are used, in aggregated or de-identified form, so we can improve them.
We do not use your personal information to make automated decisions that have legal or similarly significant effects on you.
3. Text messages and email
Order and account messages. If you give us your mobile number, we may text you about your order, and we will text you a one-time code if you ask to reset your password or verify your account. These are service messages, not marketing, and they are part of using an account.
Marketing messages. We will only send you marketing texts if you have agreed to receive them. Message and data rates may apply, and message frequency varies. Reply STOP to any marketing text to stop receiving them, or HELP for help. Opting out of marketing texts does not stop service messages about an order you have placed.
Email. You can unsubscribe from marketing emails using the link in any marketing email, or by writing to us at the address in section 12. We will still email you about your orders and your account.
4. How we share your information
We do not sell your personal information, and we do not share it for cross-context behavioral advertising or targeted advertising.
We share personal information only in these situations:
Service providers. We use other companies to run parts of our business, and they receive only the information they need to do their job for us. They include:
Square — payment processing, gift cards, and our product catalog. Receives payment details and order and transaction data.
Apple — Sign in with Apple, Apple Pay, and App Store distribution. Receives the information described in Apple's own privacy policy.
Google (Firebase) — delivering push notifications. Receives your notification token and the message content.
Our SMS delivery provider — sending order and security texts. Receives your mobile number and the message content.
Our hosting and email providers — running our servers, website, and email. Receive data stored or transmitted through those systems.
Legal reasons. We may disclose information where we are required to by law, subpoena, or other lawful request from a public authority, or where we believe it is necessary to protect the rights, property, or safety of Ma's Donuts and More, our customers, or the public.
Business transfers. If our business or its assets are sold, merged, or reorganized, customer information may be transferred as part of that transaction. We will require the recipient to honor this Policy or give you notice and a choice.
With your direction. We share information as you ask us to, for example when you send someone a gift card.
5. How long we keep your information
We keep your account information for as long as your account is open. We keep order, payment, and rewards records for as long as we need them to run the program and for as long as tax, accounting, and other laws require us to, typically seven years. Support messages are kept for as long as we need them to resolve your issue and for a reasonable period afterward. When information is no longer needed, we delete it or de-identify it.
6. Your choices and your rights
Access and correction. You can view and update your name, email address, phone number, and password at any time in the app under Account, or on our website.
Deleting your account. You can permanently delete your account and its personal information from within the app, under Account → Settings, or by emailing us at Order@MasDonuts.com. Deleting your account cancels any unused points, rewards, and coupons attached to it, and this cannot be undone. We may keep a limited record of completed transactions where the law requires it.
Marketing. You can opt out of marketing texts and emails as described in section 3.
Notifications. You can turn push notifications on or off in your device's settings for the app.
Cookies. Most browsers let you refuse or delete cookies. Essential cookies are required for ordering to work.
State privacy rights. Depending on where you live, you may have the right to know what personal information we hold about you, to get a copy of it, to correct it, to have it deleted, and to opt out of its sale, sharing, or use for targeted advertising. As stated above, we do not sell or share personal information for advertising. To exercise any of these rights, email us at Order@MasDonuts.com with the subject line "Privacy Request". We will verify your identity by asking you to confirm information already associated with your account, and we will respond within the time the law allows. We will not deny you goods or services, charge you a different price, or give you a lower level of service because you exercised a privacy right. If we deny your request you may ask us to reconsider by replying to our response.
You may also authorize an agent to make a request for you. We may ask that agent for proof of your authorization.
7. Security
We protect your information with measures appropriate to its sensitivity. Traffic between our app, our website, and our servers is encrypted in transit. Passwords are stored in a hashed form and are never stored in plain text. In our mobile app, your sign-in credentials are stored in the device's own secure Keychain and are protected by your device's passcode or biometrics. Full card numbers never reach our systems.
No method of transmission or storage is completely secure, and we cannot guarantee absolute security. If you believe your account has been compromised, change your password and contact us right away.
8. Children's privacy
Our website, app, and services are intended for a general audience and are not directed to children under 13. We do not knowingly collect personal information from children under 13. If you believe a child under 13 has given us personal information, email us at Order@MasDonuts.com and we will delete it.
9. Where your information is held
We operate in the United States, and your information is stored and processed here. If you use our services from outside the United States, you understand that your information will be transferred to and processed in the United States, where privacy laws may differ from those in your country.
10. Third-party links
Our website and app may link to other sites and services we do not control, such as Apple's App Store or our social media pages. This Policy does not apply to them, and we are not responsible for their privacy practices. Please read their policies before giving them your information.
11. Changes to this Policy
We may update this Policy from time to time. When we do, we will change the "Last updated" date at the top of this page, and we will post the updated Policy here. If we make a material change to how we handle your personal information, we will give you notice through the app, by email, or by a notice on our website before the change takes effect. Your continued use of our website, app, or rewards program after a change takes effect means you accept the updated Policy.
